Collection Notice (AU)

Eucalyptus is now part of the Hims & Hers group. This notice explains how our Australian companies (“we”, “us”, “our”) collect personal information, including:

  • who collects information, where from, and why;
  • who we share information with; and
  • and your rights to manage information.

We give this notice to you at or before the time we collect your information, including health information  (which is a form of sensitive information), as required under Australian Privacy Principle (APP) 5 of the Privacy Act 1988 (Cth). This notice is to be read together with our current Privacy Policy, which has more detail on how we handle your information and your rights as well as other consents and short-form collection notices provided at or before the time your personal information is collected.

Who is collecting your information

Your information is collected by the Australian entity that provides the brand or service you use or who you have otherwise interacted with:

  • Euc Services Pty Ltd (ACN 631 142 857) - the Eucalyptus service
  • Juniper Technologies Pty Ltd (ACN 653 673 360) - the Juniper service
  • Hims Australia Pty Ltd (ACN 631 968 486) - the Hims service (formerly the Pilot service)
  • Kin Fertility Pty Ltd - the Kin service
  • Skin Software Pty Ltd - the Software service.

The entity which initially collects your personal information may share your information with the other entities listed above, and with each of their related bodies corporate (as that term is defined in Corporations Act 2001 (Cth)) (Group), to provide our services to you.

Where we collect your information from

Where practicable we collect from you directly (for example, via our quiz, application forms, order forms, telehealth consultations, app, AI tools, correspondence, website or the Juniper community group that you complete or otherwise interact with).

Where you have consented, AI-powered transcription technology or an AI-powered chat bot (June AI) may be used to assist in collecting information from you. You will be informed every time you interact with these technologies.

Sometimes we collect information about you indirectly from other people, or in ways you may not be aware at the time. This includes from:

  • other Group entities that have provided services to you
  • our service partners who help provide your services - our registered health practitioners, health coaches, and related providers such as pathology labs and pharmacists (Service Partners)
  • your connected devices, software or apps, including through cookies, pixels and similar tracking technologies that run automatically when you visit our websites and access our services online (see ‘Cookies, pixels and online tracking technologies’ below for further information on this)
  • publicly available sources and third parties, such as our suppliers, recruiters, contractors and business partners
  • government agencies and sources, such as Medicare, the My Health Record system and the electronic prescription service

Depending on the circumstances, the third party may also tell you that they are sharing your information with us.

Collection required or authorised by law

From time to time, we may be required or authorised by or under an Australian law to collect your personal information, including under the Healthcare Identifiers Act 2010 (Cth), My Health Records Act 2012 (Cth), Health Insurance Act 1973 (Cth) and National Health Act 1953 (Cth). Because much of what we collect is health information, under these laws and State-based health record legislation, we may also be legally required to retain information, even if you ask us to delete it.

Why we collect your information

We collect your information to (among other things):

  • provide our goods and services, including to register your account, verify your identity, run the eligibility quiz, connect you with our Service Partners, help our practitioners assess eligibility, maintain health records, appointments and reminders, provide you with our goods and services, and tailor our advice
  • process payments through our third-party providers
  • communicate to you about our goods and services, including transactional messages about shipment, tracking, invoices, returns, security alerts, technical notices, and administrative support
  • send you marketing communications about goods and services offered by the Group (see below for further details on this)
  • improve your experience and our goods and services, including through analytics and research
  • identify and respond to safety risks, including contacting emergency services where we or a Service Partner believe you are at risk of imminent harm
  • comply with our legal and regulatory obligations, including reporting required under government schemes
  • consider your application for employment, if applicable

If you don't provide your information

Providing your information is generally voluntary. However, if you do not provide the information we ask for, we may not be able to provide you with the goods or services you have requested.

Cookies, pixels and online tracking technologies and opting-out

We use cookies, pixels and similar technologies to run and secure our websites, remember your preferences, understand how our services are used, and show you relevant ads on third-party platforms and across our Group websites.

This means that your browsing activity may be linked to your social media profile, particularly where you are logged into a social media account on the same device or browser.

Depending on the tracking technologies used, certain identifiers (such as hashed email addresses, hashed phone numbers or other matching data) may be shared with social media platform providers (such as Meta) to help them identify you and connect your activity across devices and services as well as across the Group. In some circumstances, this matching may occur even if you are not actively logged into your social media account at the time.

The information transmitted via tracking pixels to third party platforms and within the Group is not just technical data, it can include specific details such as: browsing specific webpages for health conditions, and your progress in completing questionnaires to determine eligibility for consults relating to specific medical conditions.

Where required by law, we will obtain your consent first and you understand that by interacting with our website information may be transmitted in this way.

Our Privacy Policy also explains how you can manage your preferences and opt-out through your device or browser settings, and via the advertising settings of the third-party platforms you use, as well as  how our AI features (including in-app AI tools) handle your information.

Direct marketing and opting out

When you provide your email address to a brand, you are signing up to that brand’s marketing subscription list, and we may send you news, offers and information about other products and services from that brand. Even if you start, but do not complete, an eligibility questionnaire, we may also send you reminders to complete your quiz, news and offers to the email address provided. 

We also use personal information we have collected about you to ensure our direct marketing is targeted and personalised to your needs. For example, we may contact you with tailored news, offers and information about products and services from other Group companies. 

 

You can opt out of marketing at any time using the unsubscribe link in any marketing email or text message, by updating your preferences in your account and/or by contacting us at the details below.

 

Opting out won't affect your treatment plan or care, and we will still contact you in connection with your treatment plan and care. Please note that if you are a customer of multiple brands, opting out of marketing communications from one brand, will not mean you are opted out from receiving direct marketing communications from another brand.

Who we disclose your information to

We disclose your information in accordance with the Privacy Act 1988 (Cth), for the purposes described in this notice, to:

  • our employees and contractors;
  • other Group entities (including for the purpose of online tracking and direct marketing)
  • our Service Partners
  • government agencies
  • marketing, advertising and social media partners
  • third party service providers, including cloud, AI and other technology service providers, payment system operators, and professional advisors
  • emergency services, where we or a Service Partner believe you are at risk of imminent harm
  • anyone else you instruct or consent to us disclosing to

We may update this notice from time to time. The current version is available on our website, and we encourage you to check it periodically. If we make a material change, we will take reasonable steps to bring it to your attention.
